Content that has received a DMCA Takedown:
The US Digital Millennium Copyright Act (DMCA), which is a US copyright law, requires us to remove content from our platform if we receive a DMCA-compliant notice from an IP holder or legal representative thereof claiming the content infringes the IP holder’s copyright. If an NFT is identified in such a notice, the NFT will be removed from display or trading on GameStop NFT. Note that the DMCA process also allows the copyright owner or legal representative thereof of the alleged infringing content to file a counter-notice. If we receive a DMCA-compliant counter-notice, we are required to reinstate the NFT on GameStop NFT, unless we are informed by the DMCA notice filer within a statutory time period that there is a filed legal action seeking a court order to prevent reinstatement of the NFT on our platform.
We encourage you to go here to learn more about the DMCA process.
Content that is in violation of Terms of Service (ToS):
We also take steps against content that violates our content guidelines and/or ToS by suspending or blocking the relevant NFTs on GameStop NFT. Examples of such violations include, without limitation, infringement of third-party intellectual property rights; infringement of an individual’s right of publicity or privacy; content that promotes discrimination, bigotry, racism, hatred, harassment or harm against an individual or group; references to GME stock, including GME meme stock references; fractional or fractionalized NFTs; and counterfeit NFTs. For more information, please go to our ToS (see, e.g., Section 8 therein). Also, NFTs that are removed in response to a court order or an order or request from a government or law enforcement agency also fall under this violation category.
Note that an NFT that violates our content guidelines and/or ToS can be suspended or, if the violation is egregious, blocked. If it is suspended, the NFT will not be available for sale but can be viewed on GameStop NFT. If it is blocked, the NFT will not be viewable or available for sale on GameStop NFT.
What can I do with my suspended or blocked NFTs?
If an NFT you own is suspended or blocked, you still have full ownership of it and it is still accessible to you via other ETH L2 platforms and UIs, like Loopring. You can also withdraw the NFT to Layer 1 or transfer it to another wallet.
To withdraw it to Layer 1, please see: How to withdraw an NFT from Layer 2 to Ethereum Network Layer 1
To transfer it to another wallet, please see: How to transfer an NFT
